WHAT ABOUT THE TENANTS IN TURKEY?

In recent months, it has been a matter of ”need” to pick up and walk his head. It turned out that all renters need the apartments they rented, their workplaces. Interestingly, all these needs corresponded to the last two three-month periods, when Turkey rental prices have increased intensively (?).

It is a fact that the rent of a Turkish house with a monthly rent of normally 2.000 TL has increased to amounts such as 4.000 TL. As it stands, Turkey property homeowners want to take advantage of this increase. And what about the tenant? There are many people around me who are suffering from the pressures of the property owner and who are paying much higher rental prices and making heavy relocation costs and changing their homes in Antalya Alanya Belek Kemer Kas Kalkan Fethiye Marmaris Bodrum Bursa and Istanbul Turkey.

It is accepted that the monthly rental prices determined in non-commercial lease agreements can increase at the maximum CPI rate at the end of the lease period. The consumer price index stands for CPI. Many renters who do not want this increase, find it scarce, send eviction notices to their tenants, claiming that “he, his child or his parents need it”.

First of all, it is necessary to address this ”need” issue. If the lessor needs housing, he has the right to request an eviction under certain conditions, of course. The main conditions for requesting an eviction are that the legal need is mandatory, real and sincere… By expressing this necessary and sincere need, the lessor must send a notice to the tenant at least three months before the end of the rental period and file for eviction within one month after the end of the rental period. Otherwise, there can be no evacuation due to necessity.

At the stage when we arrive, we are experiencing a period when the so-called needs are not real and sincere; rather, there is an intention to take advantage of living price increases… we are facing property owners who want to worsen the situation of their tenants. While it is clear that the difficult economic process cannot be overcome by individual earnings initiatives, it is worrying to make the situation of tenants financially difficult, to request more rent and to send eviction notices due to the need if they are not accepted. I would like to especially warn the owners of the property at this point. 355 of the Turkish Code of Obligations. its substance is of great importance. If the lessor has removed his/her tenant due to “need”, he/she is forbidden to rent the property to another person other than his/her former tenant for three years. Therefore, if the lessor will not use the property himself and wants to rent it again, he needs to notify his former tenant and ask if he wants to rent the property again. Otherwise, the tenant can file a compensation claim against the lessor for not less than one year’s rent.

I would also like to especially inform the tenants. If you have been evicted due to necessity, but another tenant has been taken to your old residence, you can request a year’s rent home in Turkey.
